For an agreement entered into before 1 July 2025, Virginia's bar covered only employees paid below the state average weekly wage, not every FLSA non-exempt worker.

Virginia bars non-competes for low-wage employees, and from 1 July 2025 that includes anyone entitled to overtime under the FLSA, not only those below the state average wage. A salaried associate dentist is usually an exempt professional and so usually not covered; others are judged on reasonableness.
